DUI/OWI Laws and Punishment in Michigan
If you refuse a breath, blood or urine test after an arrest for OWI (operating while impaired), OMVI (operating motor vehicle impaired) or another alcohol related charge in Michigan, your license may be suspended if you do not demand an administrative hearing within fourteen days of your arrest.
There are three distinct drunk driving offenses in the state of Michigan. The first is operating under the influence of intoxicating liquor, the second is driving with an unlawful bodily alcohol level and the third is operating while impaired.
A conviction or guilty plea for these offenses results in fines, jail time and community service time. Multiple offenses increase the punishments and a third offense becomes a felony punishable by one to five years in prison and a $5,000.00 fine. In addition, a convicted persons' license will be suspended or revoked for varying periods of time and their vehicle will be confiscated no matter who it belongs to.
