Settling vs. Going to Trial

A study of civil claims finds most plaintiffs who go to trial instead of agreeing to a settlement, often receive less money than was offered in the settlement. The study further reveals the plaintiff who went to trial did not fare as well as if they had settled in over 61% of the cases.

There are many reasons why someone may refuse to settle a lawsuit. One very common reason is they do not really comprehend the consequences of a loss at trial and for others they just cannot let go of the emotion to not give up the fight no matter what the outcome may be. In some cases the fees and costs of going to trial may be higher than the amount of the award if they do win.
