Workplace Discrimination
In order to know what to do about workplace discrimination, you must first understand what it is. Workplace discrimination occurs when an employee is treated unfairly because of his or her race, gender, age, nationality, or other legally protected characteristic. Discrimination also occurs if an employee is treated unfairly or reprimanded because he or she made a complaint for or reported an instance of discrimination.
Workplace discrimination can be difficult to prove because it is so subjective. It has to be shown that the unfair treatment was due to race, gender, etc., as opposed to poor work performance. An employee who is subject to discrimination may be entitled to receive compensation for a number of things, including:
Lost wages
Pain and suffering
Reinstatement (if the employee was fired)
Punitive damages (damages awarded in order to punish the offending party)
There is a statute of limitations in discrimination cases. That means that you have a certain amount of time after the incident in order to pursue legal options. In most states that statute of limitations is 180 days.
