Americans with Disabilities

Individuals with disabilities have certain rights when it comes to employment discrimination. In 1990 the United States Federal government enacted the Americans with Disabilities Act (ADA) to help Americans with mental or physical impairments obtain or maintain gainful employment for which they are qualified. The attorneys at Jay Trucks & Associates can help disabled individuals who have faced workplace discrimination fight for their rights.

The ADA defines a disabled individual as one:

  • Who is limited in any type of major life activity due to the mental or physical impairment
  • Who has dealt with the impairment in the past
  • Whose impairment is recognized or perceived by others

The ADA does not cover such conditions as minor illnesses, temporary disabilities or substance abuse problems.

The ADA applies to any type of employer with 15 or more employees, including:

  • Government agencies (state, local or federal)
  • Labor unions
  • Private companies or organizations
  • Employment agencies

These employers are prohibited from discriminating in any area of employment, including:

  • Job applications
  • Interviews
  • Hiring
  • Training
  • Promotions or compensation
  • Firing

If you or a loved one has been discriminated against in the workplace due to a physical or mental impairment, you may have the right to file a lawsuit against the employer. These cases are complex and require an ADA expert to help you document the alleged discrimination and file appropriate claims.

Please contact the informed, professional attorneys at Jay Trucks & Associates in Michigan today to learn your ADA rights and determine if you have a viable case against your employer.
