Discriminating against people with disabilities
There are approximately 10 million people in Michigan and of those, there are 1.9 million citizens with disabilities - that's almost 20% of our total population. It's important that we recognize the rights of the disabled and make available opportunities to them that are available to the rest of the population. According to the 1990 Americans with Disabilities Act a person has a disability if he:
- Has a physical or mental impairment that substantially limits one or more major life activities
- Has a record or history of such an impairment
- Is perceived or regarded as having such an impairment.
The ADA also provides guidelines for housing, transportation, employment, health and public accessibilities for those who are disabled. It is unlawful to discriminate in any of these areas because someone is disabled. If a disabled and abled person apply for the same job and have roughly the same qualifications, an employer does not have to choose the disabled employee. However he cannot deny the job to the disabled person because of the disability itself.
