Workers' Compensation Benefits Lower in Michigan
Michigan workers' compensation costs per claim were lower when compared to 14 other states, according to a new study by the Workers Compensation Research Institute (WCRI). Payments per claim for lost wages were 19 percent lower in Michigan.
Even though Michigan is a wage-loss benefit state, the length of temporary disability in the state was 4 to 15 weeks less than in other wage-loss states in the study.
When Michigan's benefit structure was compared to the structures of the other states:
- About 16 percent of the lowest paid workers get higher weekly benefits.
- Around 49 percent get weekly benefits that are within 5 percent of the typical benefit approach.
- Nearly 18 percent get 5-10 percent lower amounts.
- 17 percent get 10 percent lower weekly benefits.
Another factor that led to less benefits per claim for Michigan residents is that weekly benefits are based on 80 percent of the worker's after-tax income, not on the standard two-thirds of the employee's average weekly wage. Finally, the Michigan's statutory weekly benefit maximum is 90 percent of the state's average weekly pay, rather than the more typical 100 percent.
With workers' compensation benefits being less-than-ideal in our state, it is important to have an attorney review your case to incorporate any third-party elements that might increase your claim. Please contact Jay Trucks & Associates, PC at 1-800-762-8623.
